Terms and Conditions for the MAC Matcha Denim Club Promotion (Retail)

1. Organizer

(1) The organizer of the contest is MAC Mode GmbH & Co. KGaA, Industriestraße 2, 93192 Wald/Roßbach.

(2) Participation in the contest is subject exclusively to the terms and conditions listed here.

(3) Where these Terms and Conditions use the masculine form of address below for the sake of readability, this always refers to people of all genders (m/f/d).

2. Participation

(1) Participation in the contest is free of charge. A purchase of MAC pants during the promotional period is required to receive an entry card. The promotion may run until July 31, 2026.

(2) The MAC Matcha Denim Club promotion is open to all persons residing in Germany, Austria, and the Netherlands who are at least 18 years of age and who are otherwise eligible to participate in the contest as part of the MAC Matcha Denim Club promotion. Employees of the organizer and employees of participating retailers, as well as their respective family members, are excluded from participation. Participation using a false identity or the identities of third parties is not permitted.

(3) Participation requires a fully completed entry card. Participation is effected by providing one’s personal data and submitting the card to a participating retailer. Valid participation in the contest requires the cumulative fulfillment of the above-mentioned conditions; that is, all conditions must be met.

(4) The MAC Matcha Denim Club promotion takes place during a period defined by the retailer. The organizer reserves the right to change, suspend, or terminate the promotion at any time without prior notice and without stating reasons. However, MAC will only exercise this right if the proper conduct of the contest cannot be guaranteed due to technical errors, legal reasons, or force majeure.

(5) We would be delighted if participants drew attention to the MAC Matcha Denim Club promotion via social media channels. However, such posts are neither a prerequisite for participation in the contest nor do they increase the chances of winning the respective prize. The contest is not affiliated with any social media platforms and is in no way sponsored or organized by them.

(6) The organizer and the respective retailer reserve the right to verify the accuracy of participants’ information at any time prior to awarding the prize.

3. Prize

(1) An exclusive trip to Japan for two people, valued at 10,000 EUR, will be raffled off among all participants. The drawing will take place in September 2026. The winner will then be notified by mail, email, or phone using the provided address or phone number by September 30, 2026, at the latest.

(2) If the prize notification cannot be delivered, or if the winner does not respond within 7 days of receiving the prize notification by emailing the address [email address] to make their booking, the prize will be forfeited without replacement and a new winner will be drawn from among the remaining participants.

(3) The prize will not be paid out in cash and cannot be exchanged.

The prize cannot be transferred or assigned to third parties.

(4) The winner is personally responsible for complying with all entry requirements (e.g., visa, passport), necessary vaccinations, travel documents and their validity, as well as personal travel planning (e.g., connecting flights, transfers).

4. Disclaimer

The organizer assumes no liability for damage, loss, or other impairment of the prize arising after it has been handed over to the winner, in particular during the trip or due to services provided by third parties (e.g., airlines, hotels, tour operators), nor for travel changes, delays, or cancellations due to force majeure (e.g., natural disasters, pandemics, strikes). We are liable in accordance with statutory provisions for damages resulting from injury to life, limb, or health caused by a negligent breach of duty on our part or an intentional or negligent breach of duty by one of our legal representatives or vicarious agents. Otherwise, liability is excluded unless it is based on intent or gross negligence.

5. Exclusion from Participation

(1) The organizer is entitled to exclude participants from the contest if they provide false information, violate applicable law, the rights of third parties, or the rights of the organizer, or breach the terms and conditions of participation.

(2) Even a winner who has already been drawn may be excluded from the contest, which will result in the prize being awarded to another eligible participant selected by random drawing from among the remaining eligible participants.

6. Changes and Early Termination

If, due to unforeseen circumstances, the proper conduct of the contest appears to be at risk, the organizer reserves the right to modify the contest or terminate it entirely. Unforeseen circumstances include, but are not limited to, manipulation, abusive participation, or attempts thereof.

7. Data Protection

The following data is collected for participation in the contest: name, address, phone number, and email address

The personal data of participants collected in connection with the contest will be used by the organizer solely for the purpose of conducting the contest and sending the prize. You may withdraw from the contest at any time and, of course, object to the use of your data for this purpose at any time with future effect. Data will not be disclosed to third parties unless necessary for the conduct of the contest. Participants agree that by participating in the contest, their personal data will be processed by the organizer for the purpose of conducting the contest. The collected personal data will be deleted immediately after the contest has been conducted and the prize has been delivered. By participating in the contest, participants accept both the Terms and Conditions and additional privacy notices, in particular regarding their rights as data subjects, which can be found on the organizer’s website at https://mac-jeans.com/de-de/agb or https://mac-jeans.com/de-de/datenschutz.

8. Final Provisions

(1) The contest is governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) Legal recourse is excluded.

(3) If any provisions or parts of these Terms and Conditions are found to be invalid or unenforceable, the relevant provisions or parts shall be excluded and the remaining Terms and Conditions shall remain in effect

1. Organizer and Purpose

(1) MAC Mode GmbH & Co. KGaA, Industriestraße 2, 93192 Wald/Roßbach (hereinafter referred to as the “Organizer”) is conducting a contest. These Terms and Conditions apply to participation in this contest. Please refer to the description for details about the contest.

(2) The contest is not affiliated with Facebook or Instagram. The sole point of contact in this regard is the Organizer. The recipient of participant data or information is not Instagram or Facebook, but the Organizer. The Organizer can be reached at MAC Mode GmbH & Co. (3) By participating in the contest, the participant accepts these Terms and Conditions.

2. Participation

(1) The contest is open to all persons residing in Germany, Austria, and the Netherlands who are at least 18 years of age and are otherwise eligible to participate in the contest. Employees of the organizer and employees of participating retailers are excluded from participation. Participation using a false identity or the identities of third parties is not permitted, nor is participation using automated processes or technical means (scripts, etc.). Persons who engage in technical manipulation are or will be excluded from participation in the contest and the associated prize drawing (retroactively, if necessary).

(2) Participation requires a fully completed contest registration on the website. Participation is completed by entering your personal data and submitting the form. Valid participation in the contest requires the cumulative fulfillment of the above-mentioned requirements, i.e., all requirements must be met. To participate, you must also subscribe to the MAC newsletter. Once you have fully completed the confirmation of your newsletter subscription (the so-called double opt-in procedure), you are eligible to participate in the contest. You may unsubscribe from the newsletter at any time.

(3) The contest will take place from March 17, 2025, at 12:00 a.m. to April 30, 2025, at 11:59 p.m. The organizer reserves the right to modify, suspend, or terminate the contest website at any time without prior notice and without stating reasons. However, MAC will only exercise this option if the proper conduct of the contest cannot be guaranteed due to technical errors (e.g., IT malfunctions, viruses, tampering, etc.), legal reasons, or force majeure.

(4) We would be delighted if participants promoted the contest via social media channels. However, such posts are neither a prerequisite for participating in the contest nor do they increase the chances of winning the respective prize.

(5) The organizer and/or the companies involved in conducting the contest reserve the right to verify the accuracy of participants’ information at any time prior to awarding the prize.

3. Prize

(1) A trip to Japan valued at €10,000 will be raffled off among the participants. Multiple prizes per participant are not permitted.

(2) The prize will not be paid out in cash and cannot be exchanged. The prize cannot be transferred or assigned to third parties.

4. Disclaimer

The organizer assumes no liability for data loss, technical defects, or damage to the prize resulting from postal transport. Liability is also excluded in all other respects, unless it is based on intent or gross negligence. For damages resulting from injury to life, limb, or health, the organizer is liable subject to statutory limitations of liability (e.g., due care in its own affairs; slightly negligent breach of duty) only for simple negligence.

5. Exclusion

(1) The organizer is entitled to exclude participants from the contest if they provide false information, violate applicable law, the rights of third parties, or the rights of the organizer, or breach the terms and conditions of participation. A violation of the terms and conditions of participation may also consist of creating, making, or sharing comments that glorify violence, are sexist, racist, xenophobic, or otherwise harassing or derogatory.

(2) Even a winner who has already been drawn may be excluded from the contest, resulting in the prize being awarded to another eligible participant selected at random from among the remaining eligible participants.

6. Changes and Early Termination

If, due to unforeseen circumstances, the proper conduct of the contest appears to be at risk, the organizer reserves the right to modify the contest or terminate it entirely. Unforeseen circumstances include, but are not limited to, manipulation, abusive participation, or attempts thereof.

7. Data Protection

The personal data of participants collected in connection with the contest will be used by the organizer for the purpose of conducting the contest. The personal data collected for the delivery of prizes will be used for this purpose. Furthermore, we use the data you provide when participating in a contest only to the extent necessary for this purpose (in particular, email address, first and last name, and mailing address) as well as to send you information via the MAC newsletter. You may, of course, revoke your consent to the use of your data for sending newsletters at any time, with the effect that MAC will cease this type of use in the future. However, any use that occurred prior to revocation remains lawful. You may also terminate your participation in the contest and, of course, object to the use of your data for this purpose at any time with future effect. MAC Mode GmbH & Co. KGaA, Industriestraße 2, 93192 Wald/Roßbach provides participating brick-and-mortar retailers with lab-grown diamonds to be raffled off to end consumers.

2. Participation

(1) The MAC DIAMOND promotion is open to all persons residing in Germany, Austria, Italy, and the Netherlands who are at least 18 years of age and meet the eligibility requirements to participate in the sweepstakes as part of the MAC DIAMOND promotion. Employees of the organizer and employees of participating retailers, as well as their respective family members, are excluded from participation. Participation using a false identity or the identities of third parties is not permitted.

(2) Participation requires a fully completed entry card. Participation is effected by providing one’s personal data and submitting the card to a participating retailer. Valid participation in the sweepstakes requires the cumulative fulfillment of the above-mentioned conditions, i.e., all conditions must be met.

(3) The MAC DIAMOND promotional campaign takes place during a period defined by the retailer. The organizer reserves the right to change, suspend, or terminate the promotional campaign at any time without prior notice and without stating reasons. However, MAC will only exercise this right if the proper conduct of the contest cannot be guaranteed due to technical errors, legal reasons, or force majeure.

(4) We would be delighted if participants shared the MAC DIAMOND promotional campaign via social media channels. However, such posts are neither a prerequisite for participation in the contest nor do they increase the chances of winning the respective prize.

(5) The organizer and the respective retailer reserve the right to verify the accuracy of the participant’s information at any time prior to awarding the prize.

*LAB-GROWN DIAMOND

Lab-grown diamonds are man-made masterpieces produced through a controlled, technological process.

Like naturally formed diamonds, lab-grown diamonds consist of pure carbon and possess identical chemical and physical properties.

Natural diamonds form in the Earth’s mantle, at depths between 250 and 800 kilometers. There, sufficient pressure and high temperatures prevail for the valuable carbon crystals to form.

Lab-grown diamonds are created in the same way as natural gemstones. The difference is that the process is accelerated and takes place in a laboratory or factory rather than in nature.

Lab-grown diamonds are visually indistinguishable from their natural counterparts!

The CVD process is predominantly used for production. CVD stands for chemical vapor deposition. In this process, carbon atoms are exposed to extreme heat and pressure under controlled conditions to mimic natural diamond formation.

Laboratory-grown diamonds are real diamonds—just with a different origin.

They are optically and chemically identical, so they cannot be distinguished by the naked eye, and special equipment is required to tell them apart.
